Briefing Complete/Transfer Pending
Briefing is now complete before the Third Circuit US Court of Appeals in United States v. Mark Jordan. The question before the Court is complicated, asking that it decide whether, in light of the Supreme Court’s recent decision in Borden v. United States, Mark’s 1994 bank crimes meet the definition of “categorical crimes of violence.” A ruling in Mark’s favor would reduce his release date from 2047 to 2028, and provide grounds for an immediate release request. Although the Third Circuit has been among the most prosecution-biased appeal courts in the nation, we remain hopeful and believe in the correctness of our position. We expect a decision within 2-4 months, but it is important that we remain vigilant in our continued demand that President Biden commute Mark’s prison sentence. The USP Tucson warden has recent;y submitted a request that Mark be transferred to the lower security prison in Fairton, New Jersey. We just got word that the Department of justice has approved the request. Mark will be without a mailing address until the transfer is complete.
